K. Metzler called the meeting to order at 7:39.


New Business

2009-21 Application for split of parcel into two lots and the construction of two single family homes, driveways and associated activity at the intersection, east side of Marsh Road & north side of Boston Tpke (Rte 44). (Map 6 Lot 10 Zone R80) Owner/Applicant: Jennifer & Michael Genesse (Received September 14, 2009 Public Hearing by Nov 9, 2009 Decision within 35 days after close of P.H.)

Wes Wentworth of Wentworth Civil Engineer in Lebanon was present for the applicant.  Mr. Wentworth is a Soil Scientist and Engineer and presented plans to the commission.  He said the parcel is in a R80 zone and they would like to divide the property in half.  Mr. Wentworth gave the history of the property and said in 2005 the current owners purchased the property and came before the commission to timber the property in which they have done.  He said the landowners met with Gary Jones last spring regarding the house locations and a property split.  Mr. Wentworth said they were looking to have 2 separate driveways but G. Jones asked them to look at better alternatives.  Currently they are looking to improve the existing gravel/timber road for the common driveway which would split off into 2 private drives and they felt this was a better alternative.  

Mr. Wentworth showed the outlined upland review on the plans and said the plan is for 2 single family dwellings with separate septic and wells and that they have received approval from the Health Department.  He said they will not pave the gravel road.  K. Metzler asked if the crossing on the wetlands is wooded and Mr. Wentworth said yes.

Mr. Wentworth said the driveway width is 14 feet, the common drive will be 700 feet long and the two split driveways will be 800 and 400 feet.  A discussion was held on a turnaround / pull off for emergency vehicles.  

K. Metzler asked about sedimentation and erosion control and Mr. Wentworth said it is in the plans.  A discussion was held on culverts.  Mr. Wentworth showed the proposed septic and wells on the plans and said the homes will be 4 bedrooms.  

S. Yorgensen said Gary Jones did walk the site and gave his input.  The commission requested the following; DEP Reporting form submitted, John Ianni’s report and comments, further detail including stabilization of the driveway details and cut, details for the culverts, and they would like Karl Acimovic to look at the drainage calculations as well as fire marshall/departments input on the proposed drives.  

The commission agreed that a public hearing was not required due to minimal disturbance in the wetlands.  The applicant will attend the next meeting on November 9, 2009.  

W2009-25 - Application for Lot split for proposed 3 bedroom house in upland review area at 22 Moose Meadow Rd (Map 21 Lot 7 Zone R80) Owner/Applicant: Earl & Martha Gledhill (Received October 26, 2009 Public Hearing by Dec 14, 2009 Decision within 65 days after close of P.H.)

Application was received tonight.

Old Business

W2003-49 Notice of violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

Tabled for this meeting.

Correspondence

1.  Letter from Ottery Group regarding a telecommunication facility.

2.  DEP Notification – 2009 Segment 3 Scheduling

3.  CACIWC – Notification of the annual meeting on Nov. 14, 2009.

4.  Email from James Poole regarding the logging regulations and requesting a formal response.  

The commission recalled that unless the Board of Selectmen take action they cannot take any action regarding the logging regulations.  This item was tabled for this meeting.  

Minutes

T. Gutowski motioned to approve the minutes with the following modification; D. Schreiber was excused from the meeting of Sept. 28, 2009.  All voted in favor.  Motion carried.
